What Are Compliance Certificates?
Compliance certificates (COCs) are documents issued by qualified, registered inspectors or tradespeople confirming that a specific installation or system in a property meets the applicable safety standards and regulations. In South Africa, the seller is legally required to provide certain COCs to the buyer before or at the time of transfer.
Failure to provide the required certificates can delay or prevent transfer. If a defect is discovered after transfer that should have been certified, the seller may be held liable under the voetstoots clause, the Consumer Protection Act, or the relevant safety legislation.
Electrical Certificate of Compliance
The Electrical COC is required under the Occupational Health & Safety Act and its Electrical Installation Regulations. It must be issued by a registered electrical contractor and certifies that the wiring, distribution boards, earthing, and visible electrical infrastructure are safe and compliant. Typical cost: Rย 1ย 500 (range: R935 โ R2ย 750).
Plumbing / Water Installation COC
Required by most South African municipalities under their Water Services bylaws. It certifies that the water and drainage installation is compliant โ no leaks, no cross-connections, and that the water meter is functioning correctly. Typical cost: Rย 1ย 000 (range: R800 โ R1ย 500).
Gas COC (if applicable)
If the property has a fixed gas installation โ including gas stoves, ovens, gas geysers, or gas braais connected to a fixed supply โ a Gas COC is required under the Pressure Equipment Regulations, 2009. It must be issued by a registered gas practitioner from the LP Gas Safety Association of Southern Africa (LPGSASA). Typical cost: Rย 800.
Electric Fence COC (if applicable)
The Electric Fence System COC is required under the Electrical Machinery Regulations, 2011, whenever an electric fence changes ownership or is modified. It must be issued by a registered electric fence system installer. The certificate confirms the fence complies with SANS 10222-3 and the Energizer Standard. Typical cost: Rย 1ย 800.
Beetle / Borer Certificate
While not a safety COC, the beetle certificate is legally required in KwaZulu-Natal, the Western Cape, and parts of the Eastern Cape (coastal areas) and is standard practice across South Africa. It certifies that the property is free from wood-boring beetle infestation (notably the Hylotrupes bajulus and similar species). Typical cost: Rย 600.

Her required certificates are: Electrical COC (R1,500), Plumbing COC (R1,000), Beetle Certificate (R600), Gas COC (R800), and Electric Fence COC (R1,800).

The electrical inspection reveals an outdated distribution board. The electrician charges an additional R4,500 to upgrade it before issuing the certificate. Who pays for compliance certificates in South Africa โ buyer or seller?
The seller is responsible for obtaining and paying for all compliance certificates in South Africa. This includes the Electrical COC, Plumbing COC, Gas COC (if applicable), Electric Fence COC (if applicable), and the Beetle Certificate. These costs are typically settled from the proceeds of the sale before transfer.
Are compliance certificates valid for a specific period?
Validity varies by certificate type. The Electrical COC is technically valid for 2 years but is only valid for the installation as inspected โ any modifications require a new COC. The Beetle Certificate expires after 3 months. The Gas COC is valid for 5 years (or after any modification). The Electric Fence COC is required fresh at each transfer. If your certificates have expired, you will need new ones before transfer can proceed.
What happens if the property fails a compliance inspection?
If the inspector finds non-compliant work, they will issue a list of defects that must be remedied before the certificate can be issued. The seller is responsible for the cost of both the inspection and the repairs. This is why compliance costs can vary significantly โ a property with old wiring or a leaking geyser will cost far more than a well-maintained property. Always budget a contingency of at least 30โ50% above the base inspection fee.
Do apartments (sectional title) need the same compliance certificates?
For sectional title apartments, the position is more nuanced. The Electrical COC is still required for the individual unit. The plumbing responsibility often falls on the body corporate for common-area plumbing โ sellers should confirm with the managing agent what the body corporate's compliance status is. The Beetle Certificate applies to the unit. Gas and electric fence COCs apply if those installations are within or exclusively serve the unit.
Can I sell a property without compliance certificates?
It is technically possible to include a contractual arrangement where the buyer takes responsibility for obtaining certificates (e.g., an "as is" clause), but this is unusual and risky for both parties. Banks financing the buyer's bond will typically require the Electrical COC before granting a home loan. Most conveyancing attorneys will not proceed to lodgement without all required certificates in hand. Attempting to transfer without required COCs exposes the seller to legal liability.
